Flood insurance seems to be simple, doesn’t it? See if the property is prone to flooding and if it is, insure the structure. How hard can that be? Well, as we know, there are always complications. There’s a lot going on with flood insurance, headlined by the private flood policy final rule, which was a long time coming. We’ll discuss this as well as other updates, including what to look forward to once Congress (inevitably) amends the National Flood Insurance Act.

Although the CFPB appears to be a bit quieter since PHH, the other prudential regulators continue to be vigilant with potential RESPA Section 8 issues and concerns.  This session will focus on “things of value” potentially impacting your institution’s compliance risk under Section 8.  We will take a keen look at marketing service arrangements and agreements and how to avoid the “referral” pitfalls by leveraging consent orders, HUD guidance and more.

Now that those new 2018 data elements have been submitted, we can think about other things and put HMDA on the shelf until next year, right? Not so fast – there are further changes to the rule coming (including possible elimination of a few of the new pieces of data) and the threshold rules. We’ll discuss these as well as many of the HMDA hot spots lenders continue to face. As well, we’ll discuss some of the interesting observations that came from the public release of the 2018 data, and what banks should do now that the information is public.

While this session will cover the science of scoping and conducting a fair lending risk assessment, the primary focus will be on the art of risk assessments:  identifying areas of fair lending risk and what that risk means for your institution. We will discuss strategies to assess fair lending risk in Redlining, Underwriting, Marketing, Pricing, and Steering and present solutions to streamline the assessment. The session will do a deeper dive into redlining risk and discuss how to assess your bank’s redlining risk in light of recent enforcement actions and regulatory examinations.

Despite available penalties under Reg E itself, UDAP/UDAAP is often cited in lieu of or in conjunction with Reg E violations.  We will explore key Regulation E and UDAP/UDAAP issues that arise, including unauthorized transactions, stop payments, overdraft and compulsory use.
